GENERAL TERMS FOR USING SLEDENJE.COM PLATFORM

General terms for the use of the web system Sledenje.com represent terms for use of web service for tracking, management and controlling vehicles, which is enabled by the company Sledenje, Informacijske rešitve d.o.o. as a service provider (hereafter called Sledenje).

Sledenje.com system represents an effective service for fleet management, which can optimize the working process vehicle fleets with the help of modern Information Telecommunication technologies. The system fundamentally effects and improves business operations.

Sledenje will equip the clients driving pool with mobile units that include a GPS receiver, modem with SIM card and ins/outs to connect any peripheral devices. With mobile units equipped the vehicles are activated into the system Sledenje.com. To access Sledenje.com services the company Sledenje creates a user name and password for the client.

Explanation of Concepts which appear in general terms:

Sledenje.com is a web system for fleet management, maintenance and vehicle control.
User package consist of rent of mobile unit, mobile operator SIM card, mobile unit installation, access to web system Sledenje.com, which enables the use of the system and it’s services.
Mobile unit is a component of the Sledenje.com system. It is installed into the vehicle and enables real-time vehicle tracking and status of the connected devices at all times.
Data transfer is running through infrastructure of mobile operators.
Access to the system: the client accepts a user name and password for the use of the system Sledenje.com during the agreed period. The client uses the login information to reach the web system of Sledenje.com, which enables the use of Sledenje service, maintenance and vehicle control.
Agreement for renting defines the relation between the company Sledenje and Client as well as the ability to use system Sledenje.com.

The renting relationship is activated when both parties confirm and sign the agreement for renting Sledenje.com system. Sledenje agrees with the client with one renting agreement for one or more vehicles, which are activated into the system Sledenje.com.

The company Sledenje will agree to the renting relationship for using the system Sledenje.com and it’s services with each interested customer, solvent physical or legal person, which fulfill the following conditions:

Physical person:

1. to be over 18 years old;
2. to quote exact and correct information in the contract;
3. to guarantee an income and personal bank balance to cover the renting costs;
4. has all due invoices from passed relationships with Sledenje covered and parties have not been involved in any legal conflict.

Legal entity:

1. to guarantee payments via a legal bank account;
2. to quote exact and correct information in the contract;
3. to have all due invoices from passed relationships with Sledenje covered and parties have not been involved in any legal conflict.
4. to confirm the agreement with a legal representative or any other procurator and its written authorization.

The company Sledenje is entitled not to confirm an agreement for renting or to cancel an already confirmed agreement in case of the clients actions that are not in accordance to the demands of set agreement or the client acts opposite to the general terms in the agreement for renting or legal regulations.

The activation is possible only for users of the system Sledenje.com, who have confirmed and signed the agreement for renting the system and service of  Sledenje.com.

The client accepts the user name and password to access the system during the agreement period. Username and password can be used only by the renter’s legal representative or its authorized personnel.

For using the SIM card a valid GSM network concessionaires general terms are in place, which are presented to the client of Sledenje before the confirmation of the agreement.

The company Sledenje has presented all terms and rules of using Sledenje.com system to the client before signing the agreement. The client is bound to respect the rules and terms of set agreement and use the system Sledenje.com in accordance to those rules.

Information related to the agreement relationship are a business secret of the company Sledenje. Sledenje will use and work with data connected with the agreed relationship in accordance with all legal regulations regarding personal data.

In case of unauthorized use the client must report such events promptly to the provider of the system Sledenje.com verbally and in written form. If the report is verbal the client has to evident the exact date and tne individual’s name to whom the report was transmitted too. The verbal report has to be confirmed in written form within 24 hours or else the verbal report is not valid.

In case of alienation of username and password information and in any case of unauthorized use, the company Sledenje will block the access within the 24 hours of the clients report.

In case of alienation, loss or demolition of a device which belongs to the company Sledenje, the client is responsible to carry costs of full value of this device.

User of the Sledenje.com system has to report each claim within the legal period. The claims can be reported verbally or in written form. If the report is verbal the client has to evident the exact date and the person’s name to whom the report was transmitted. The verbal report has to be confirmed in writing within 24 hours or else the verbal report is not valid.

Sledenje is not responsible for the disturbance in the system and related damage which could appear to the client in case if:

1. there are defects, distractions or loss in GSM network functionality;
2. there are mistakes, distractions or loss of internet connection between provider and client;
3. there are mistakes, distractions or loss of GPS system;
4. client does not respect the general terms of the GSM network concessionaire;
5. there are mistakes on maps;
6. the username or password is estranged,
7. the mobile unit is damaged or estranged,
8. there are damages on the mobile unit as a consequence of unsuitable handling by the client.

The company Sledenje is entitled to disconnet the client from the system in case the client is not acting in accordance with the general terms, the agreement or legally valid regulations.

The costs of the disconnection from the system are carried by the client. The costs for activation and disconnection of the system Sledenje.com are invoiced from Sledenje’s valid price list.

Sledenje.com system services are payable and are invoiced in accordance with the Agreement.

In case the client delays with the payment Sledenje is entitled to invoice the client legal interest for not paid invoices.

In case of forcible recovery of payments the client is responsible to carry the costs of the recovery with all court costs related to the client and his due payments to Sledenje.

Sledenje is entitled to change the general terms of operation or price list for it’s services or any other possible paid services.

Each change has to be reported by the company Sledenje to the client of the system Sledenje.com, so that the users are made aware of the changes on time.

In case of cancelations of the renting relationship, the client is responsible for all obligations related to the Agreement, which occured as a consequence of using the system Sledenje.com, counting all the way to the last day of the valid relationship.

Sledenje.com is a trademark of the company Sledenje d.o.o.

The system Sledenje.com, its name and logo, as well as all other mentioned names and services content belongs to its’ owners. Any use of them with any purpose is not allowed without the owners consensus and will be prosecuted.
